Wills

A Will is a formal legal document which sets out what happens to your money, property and possessions on death. If drafted well it should be capable of lasting a lifetime without requiring any formal amendments. Without a valid Will your money, property and possessions may be shared out amongst family according to set rules regardless of any wishes you may have expressed.

Our Barristers are experienced in drafting Wills, and advising on their validity and effect, and are able to offer the following services on fixed fees:

Drafting simple Wills

For an individual, a Will: (1) leaving everything to named individuals or charities; (2) leaving everything to a spouse or partner with gift over to named individuals or charities in the event the spouse or partner has died; or (3) leaving everything to a spouse or partner with gift over to children.

For a couple (two Wills in mirrored terms): (1) leaving everything to a spouse or partner with gift over to named individuals or charities; (2) leaving everything to a spouse or partner with gift over to children.

These simple Wills include provision for funeral wishes, appointment of guardians for minor children, and gifts of specific items of furniture or jewellery.

Drafting more complex Wills

For an individual: including a Will establishing discretionary trusts (a flexible trust where money or property may be applied for the benefit of one or more of a class of beneficiaries at the discretion of appointed Trustees) or life interest trusts (where income or the benefit of property is applied to a named beneficiary during their lifetime but the capital value of the trust is preserved for another).

For a couple (two Wills in mirrored terms): including Wills establishing discretionary trusts or life interest trusts.
